Colombo Chief Magistrate issues show cause notice on FCID Director Featured

Colombo Chief Magistrate Gihan Pilapitiya on July 3 issued notice on the Finance Crime Investigation Division Director to show cause, as to how a court order was received to conduct a second audit on the bank accounts of former Sri Lanka Football Association president Manilal Fernando and another person, when an order has already been issued by the Court of Appeal preventing the auditing of accounts for the second time.

The notice ordered the FCID Director to appear before courts on July 28 and show cause.

This notice was issued by the Colombo Chief Magistrate after considering the reasons given by the lawyers appearing for Manilal Fernando and Executive Officer Krishantha Perera of the said Association. According to the Audit Reports covering the years 2006 to 2014, there had been alleged misappropriation of money. The FCID requested court to grant permission to peruse the accounts maintained by Manilal Fernando and Krishantha Perera to ascertain who was responsible for the alleged misappropriation of money.

Considering the request the courts issued the said notice. On June 17, the courts had granted permission to peruse the accounts maintained by the said officers.

Nalin Ladduwahetti PC and Ronald Perera PC appeared for both Manilal Fernando and Krishantha Perera.

Counsel appearing for the two complainants told court that the Government Auditor General has presented an Audit Report with regard to the accounts of the Football Association. But, the former President of the Football Association Ranjith Rodrigo had called for an Audit Report once more. The Association had presented photocopies of the accounts in possession of the association, to prepare the Audit Report for a second time.

Manilal Fernando got the Court Appeal to issue an Interim Order, preventing a second audit being conducted. That Interim Order is in effect until July 28. On May 9, steps were also taken to make the FCID aware about the Interim Order issued by the Court of Appeal making Ranjith Rodrigo and the Government Auditor respondents.

The case was called and a motion filed and although the lawyers appearing for the FCID were duly informed, no police officers appeared before courts.
