SC allows petition on mental distress due to non-enforcement of law Featured

The Supreme Court has granted leave to proceed with a petition that seeks a clarification as to whether mental distress suffered by an aggrieved party due to the failure to enforce the law properly can be considered under clause 11 of the constitution.

A panel comprising Eva Wanasundara, Anil Gunaratne and Buwaneka Aluvihare gave the order yesterday (29) after considering a petition filed over the non-enforcement of the law pertaining to an incident in 2010-11 in which a youth was knifed to death.

The Moratuwa and Moratumulla police have been evading legal proceedings for more than four year, citing that they were seeking the attorney general’s advice.

The next hearing of the petition has been fixed for March 08.
