President's reelection will be unlawful says ex-Chief Justice Featured

A re-election of President Mahinda Rajapaksa at next month's election could result in his victory being declared null and void by the Supreme Court according to Clause 83 of the Election Act for violating the law, former Chief Justice Sarath N Silva has said.

He made the announcement at a Press Conference held on Thursday (December 25).

He said the Law violation in the run-up to the election was in the form of a fraudulent document with the forged signatures of UNP leader Ranil Wickremasinghe and Common Opposition candidate Maithripala Sirsena put out by President Mahinda Rajapaksa's Health Minister Tissa Attanayake claiming it to be a secret pact between the two.

The former Chief Justice Sarath N Silva stated that as a result of Legal action taken against Attanayake, the Supreme court will have the power to declare any re-election of President Mahinda Rajapaksa as unlawful.

"Under Clause 83 of the Election Act it is unlawful for a candidate to declare false information as well as for a candidate to indulge in any act that is unlawful or publish any information that is untrue. Both Ranil Wickremasinghe and Maithripala Sirisena have declared that the document is false and the reaction of the two should have been sought before publishing in the newspapers which was not done. This is what puts it in conflict with Clause 83 of the Election Law. Because of this violation any re-election of President Mahinda Rajapaksa can be declared null and void by the Supreme Court", said Sarath N Silva.
