He asked the CID and lawyers for the aggrieved party as to whether he should merely do the bidding of the police in this case.
The suspects have been remanded further until March 29, but the magistrate asked as to how he could take the case further without concrete evidence.
CID’s ASP Shani Abeysekara said the suspects had used three Army vehicles which had travelled 900 km during a particular day.
However, the Army has not yet provided the documents pertaining to these vehicles and their movements, which has come in the way of the investigation, he said.
On a request by Abeysekara, the magistrate ordered the Army to provide the documents in question and to send an audio given by the Army to Prof. Gihan Wickremanayake of the Colombo University for a report.
He further requested the Army commander to provide documents of the Giritale MIC camp on 25 January 2010, the day Ekneligoda was abducted, and particulars of the vehicle used by the first suspect, Shammi Arjuna Kumararatne.
Along with Kumararatne, other suspects – N.T. Praboda Siriwardena, R.M. Priyantha Kumara Rajapaksa alias Nathan, Wadugedara Winnie Priyantha, Dilanjan Upasena, S.M. Ravindra Rupasena alias Ranji, Y.D. D. Kumara Abeyratne, S.M. Kanishka Gunaratne, Ayyasamy Balasubramaniam and D.N. Tharanga Prasad Gamage – were produced before courts.
State counsel Dileepa Peiris told courts the CID could file murder charges against the suspects, claiming availability of clear evidence to do so.
