The complaint is an attempt to raise national and international awareness about the counterproductive nature of the US-sponsored resolution on Sri Lanka that adopted at the UN Human Rights Council in Geneva.
The VIP says in a statement that it wants to emphasize that in a divided society like Sri Lanka, if one starts, the other will also react and then, both parties will continue without reaching an end.
As the VIP believes, the UNHRC proposed ‘internationalized Nuremberg type of domestic mechanism’ that aims at bringing justice by punishing people would not only be conducive to reconciliation but could be a witch hunt.
“Eye for eye, tooth for tooth” is not the principle that should guide the post-war Sri Lankan affairs and we must follow the path of love and forgiveness which emphasizes the eternal truth that “Hatred never ceases trough hatred, but through love alone they cease”.
The VIP was compelled to make this complaint against the LTTE and its affiliated organisations and living individuals named by the State as we are convinced that ‘deeds are louder than words’, even in the current national and international political context.
We saw many peace-lovers tried to raise their voices against the US-UN led attempt in adopting a punitive justice model for post-war Sri Lanka.
Unfortunately, those peace-lovers’ voices were ignored and went unnoticed.
Therefore, the VIP has decided to resort to deeds than to words until our voices are heard and recognized.
As we observe, the primary responsibility of the State in post-war Sri Lanka is to break the cycle of hatred and mistrust between ethnicities that could pave the way for another disaster.
Therefore, the country should adopt a process of sustainable reconciliation and the reconciliation is the most important issue than any other issue in post-war Sri Lanka.
However, the UNHRC resolution that adopted a punitive justice model in addressing post-war Accountability issue would be counterproductive as retribution has the potential to spread more hatred and mistrust between ethnicities that could ignite the flare of violence.
Therefore, the VIP’s proposition is that the State and International Actors should avoid any kind of punitive justice mechanisms when addressing post-war Sri Lankan issues.
The VIP by making a complaint has requested the police to inquire and take appropriate actions at least against 16 organisations and 424 individuals that were designated under the paragraph 4(2) of the United Nations Regulations No. 1 of 2012 and by the Extra Ordinary Gazette No. 1854/41 - FRIDAY, MARCH 21, 2014 of the Democratic Socialist Republic of Sri Lanka for alleged crimes committed by the LTTE.
Furthermore, we have requested the police to inquire into violent incidents that perpetrated by the LTTE from 1976.
We hope that in handling our complaint, the government of Sri Lanka would display the same enthusiasm that they displayed when adopting a joint resolution with US at the UNHRC in Geneva.
Therefore, we are confident that the police would take necessary steps immediately to send requests to relevant countries to extradite suspects in accordance with the provisions laid out in the Resolution 1373 (2001) Adopted by the UN Security Council at its 4385th meeting, on 28 September 2001.
Furthermore, we expect that the UN member countries that unanimously approved the UNHRC resolution on Sri Lanka would extend the same support they extended in Geneva by respecting the Resolution 1373 (2001) Adopted by the UN Security Council at its 4385th meeting, on 28 September 2001 and would extend their assistance to Sri Lanka by extraditing required suspects.
Nonetheless, in an event that the police could not get hold of any suspects with the assistance of other UN countries, the police could arrest suspects if they come to Sri Lanka to attend the Diaspora Festival in December that was proposed by the Minister of Foreign Affairs Mr. Mangala Samaraweera.
Hence, the VIP is certain that the UN member countries and the government of Sri Lanka would help us in bringing justice against the LTTE atrocities by assisting the Sri Lankan Police to conduct this inquiry.
