The Supreme Court on October 03 received a fundamental rights petition that seeks cancellation of the controversial coal supply tender granted to Swiss Singapore Overseas company.

If the tender is given to the said company based on incorrect information presented by the power and energy minister to the cabinet, that amounts to a FR violation of the public as per clause 12 of the constitution, says petitioner Subhash Jayawardena, deputy editor of ‘Sathhanda.’

A three member bench of judges headed by the chief justice will take up the petition on October 14.

The public interest litigation says granting the tender to the said company will cause unnecessary expenditure for the state that will be passed on to the public.

It seeks to obtain legal assistance to prevent the tender from being granted to the said company.

The respondents cited are president Maithripala Sirisena, prime minister Ranil Wickremesinghe, subject minister Ranjith Siyambalapitiya and the rest of the cabinet members, ministry secretary Dr. Suren Batagoda, Lanka Coal company and its chairman Maithri Gunaratne and director board, Swiss Singapore Overseas company, cabinet appointed procurement committee chairman G.S. Vithanage, additional director to State Policy Department A.K Seneviratne, Air Force director of finance G.R.L. Wasantha, ministry additional secretary S.A.N. Saranatissa, CEB general manager M.K.C. Wickramasekara, cabinet secretary Sumith Abeysinghe, Nobel Resources company and the attorney general.
